Boy Meets Girl Forever Young NYFW Decalz Contest Terms and Conditions

To be eligible to participate in the Boy Meets Girl Forever Young NYFW Decalz Contest (“Promotion”) and to win the Grand Prize, you:

• Must be a resident of the United States;

• Must be a Lockerz member in good standing (i.e., in compliance with the Lockerz Terms of Use);

• Must be 18 years old or the age of majority in the state or jurisdiction in which you reside (whichever is older) or have the permission of a parent, guardian or other legally responsible adult to participate;

• Once Lockerz select a member from among those who are eligible and have submitted a Qualified Collection (as defined below), that member also must respond to the notice sent by Lockerz and must do so no later than 12:00 pm Eastern Daylight Savings Time on September 23, 2012. As part of that response, the selected member must provide Lockerz with a) First and last name; b) Home and mailing address; c) Current working phone number; and d) Current email address with such information corresponding to that contained in her/his membership account registration.  Lockerz also may require the member to also provide written proof verifying such information and age (and, if a minor, provide a signed parental or guardian consent). Any failure to provide timely, complete or accurate responses will result in the disqualification of that member, the forfeiture of the prize, and the selection of an alternate as a possible Grand Prize winner.

Two Grand Prize Winners will each receive the following items:

• Selected Boy Meets Girl apparel from Lockerz.com up to an estimated retail value of $100 USD, not including any discount available through the use of PTZ(r).

1) No purchase is necessary to enter or win the Boy Meets Girl Forever Young NYFW Decalz Promotion (“Promotion”). Nor will a purchase affect the chances of you or your collection being eligible or qualified for or awarded any of the prizes.
2) By entering, you confirm that you have read, accepted and agreed to abide by the Lockerz Terms of Use and Privacy Policy and that you are in full compliance with them. You acknowledge and agree that under the Terms of Use and as part of the terms and conditions of this Promotion, Lockerz in its sole discretion will make all determinations regarding eligibility (yours and that of submitted collections, Decalz, images and other content), selection of Submissions and all other aspects related to this Promotion, unless expressly stated otherwise. Lockerz has the right to determine, confirm, and/or re-evaluate eligibility requirements at any time, including without limitation, after any selection, notification, or announcement of a prize. All Promotion-related determinations will be final.
3) This Promotion and/or your participation in it is void where prohibited by law, rules or regulations, is time limited, and is subject to all of the terms and conditions set forth. By choosing to participate, you represent to Lockerz that your participation is not prohibited. Lockerz also reserves the right to cancel, suspend, or modify part of or this entire promotion at any time without notice, for any reason in its sole discretion, including without limitation, the actual prizes to be awarded.

Selection and Eligibility Criteria:
4) Each collection must meet the following criteria in order to be deemed a “Qualifying Collection” and considered as a valid entry for any prize:

a. Submitted and uploaded or posted on www.lockerz.com no earlier than 12:00 a.m. Eastern Daylight Savings Time on September 10, 2012 and by 11:59 p.m. Eastern Daylight Savings Time on September 21, 2012;

b. Consisting of at least 10 Decalz that include i) your musical inspiration, ii) your favorite Boy Meets Girl styles from Lockerz.com, iii) your favorite charitable causes and iv) other inspiration.

c. Specifically be titled or named “Forever Young”

d. Must be shared via Twitter using the hashtag #ForeverYoungNYFW, and tag @BoyMeetsGirlusa, @StacyIgel and @Lockerz;

e. Comply fully with the Terms of Use, including without limitation, all requirements for Submissions and not contain, reflect, or be the product of any prohibited activity. As an example, you have the right to use the material in the Submission and none of the Decalz that make up a collection can be in Lockerz’s assessment defamatory, obscene or indecent, threatening, discriminatory or otherwise contain or depict anything offensive or inappropriate.

5) Lockerz alone and in its sole discretion will make all determinations related to a collection’s eligibility as a “Qualifying Collection,” and all such determinations will be final. Those determinations include but are not limited to whether a collection has met the required time deadlines, which will be based on Lockerz’ computer systems, not on any of your systems or devices, and whether any collection, considered in whole or in part, contains, reflects, or is the product of any prohibited activity. Lockerz reserves all rights under the Terms of Use, including the right to remove any Decalz or collections and to take actions related to the member that it deems appropriate, up to and including, termination of the membership.
6) Each participant may create as many Forever Young Collections as she or he wishes.
7) Subject to a determination that the submitted Forever Young Collection is a Qualified Collection and that the corresponding Lockerz account holder is eligible, two (2) Grand Prizes will be awarded. The potential Grand Prize Winner will be selected by Stacy Igel, Boy Meets Girl and Lockerz staff based on the collection’s creativity, originality, style and capturing of the Forever Young theme.  Odds of being selected will vary based on a number of factors, including the number of Qualified Collections and eligible members that may be considered and the skill of those submitting Qualified Collections.
8)  The potential winner(s) must respond to the notice of selection received from Lockerz no later than 12:00 pm Eastern Daylight Savings Time on September 23, 2012.  If the potential winner fails to respond in time, the potential winner will be disqualified and the prize will be forfeited.  If the potential winner is unable or unwilling to provide or verify all registration and response information, the potential winner will be disqualified and the prize will be forfeited.   Notification will be deemed to have occurred immediately upon the sending of an email or any other form of communication Lockerz may use to contact the potential winner.  Lockerz is not responsible for and will not be liable for any late, misdirected or unsuccessful efforts to notify a potential winner or for any late, misdirected, incomplete, or unsuccessful efforts of the potential winner to respond and/or provide the information requested as part of verification.   Lockerz has no obligation to use more than one method to notify a potential winner or, if it elects to use a phone number provided by the potential winner, to leave a voicemail or other message.
9) The estimated approximate retail value of a Grand Prize is $250. There will be no substitute item(s) awarded, except at the sole discretion of Lockerz. Lockerz will not redeem any prize or portion thereof for cash value. Nor will the prize winner be entitled to any refund or credit if she or he selects Boy Meets Girl merchandise whose estimated retail price is less than the $100 USD allotted as an element of the Grand Prize.
10) If your participation in this Promotion is terminated by Lockerz for any reason prior to the completion of any activity related to Promotion, including but not limited to the selection of Prize Winners, there will be no cash or other compensation provided to you. Lockerz also reserves the right to select another Prize Winner if you are unable or unwilling to fulfill any requirements, fail to respond within five (5) days after initial prize notification, or are determined at any time to have been ineligible or have engaged in conduct rendering you ineligible.

Additional General Requirements:
11) Chances of winning will vary depending on many factors, including the skill you and other entrants demonstrate and the total number and quality of Qualified Collections submitted. Your participation in this Promotion is subject to and may be void or restricted based on the laws, regulations or rules where you live. If you are under the age of majority where you live (e.g., under the age of 18), you need the permission of a parent, guardian, or other legally responsible adult to participate.
12) By entering this Promotion, you agree that no Submission is being made for a commercial purpose and that you bear sole responsibility and liability for any and all costs, expenses, acts or conduct, whether intentional or unintentional, related to your participation in this Promotion. Lockerz bears no responsibility for and expressly disclaims any liability for the acts or omissions of you and anyone else involved in any aspect of your participation in the Promotion. You also agree to release Lockerz, its directors, officers, employees, representatives and agents from any and all liability arising out of any aspect of your participation in this Promotion, whether under a theory of contract, tort, warranty, or other theory.
13) If selected as a Prize Winner, you agree and grant Lockerz the right to publish, display, make public, or otherwise use the following personal information, including on any publicly accessible portion of the Website (e.g., Decalz Feeds or the Lockerz Blog) or through other social media (e.g., on the Lockerz Facebook page or Twitter account): (1) Your first name and last name and (2) your city, state (if applicable), and country. You also understand and agree that this express consent to disclose certain personally identifiable information is consistent with the Lockerz Privacy Policy whose terms are a condition of and govern your use of the Website and could result in this information appearing elsewhere, whether online or offline, without further action or fault of Lockerz.
14) A list of Prize Winners will be posted at the Lockerz Blog (http://blog.lockerz.com/) on or around September 25, 2012.
15)  Lockerz reserves the right to suspend, cancel, or terminate this Promotion or declare it null and void and not award or rescind any prize, if in its sole discretion, Lockerz determines that the rules and integrity of the Promotion have been violated or compromised in any way by any person, whether a participant or non-participant or that it is not possible or no longer practical to complete the Promotion as planned.  Lockerz also reserves the right to amend these Terms and Conditions at any time for any or no reason.
16) Employees of Lockerz, Inc. and their immediate families may create Forever Young Collections, but are not eligible to have any such collections considered as a Qualifying Collection or to win any prizes associated with this Promotion.
17) No third party, carrier, merchant or service provider that may be used in connection with your participating in this Promotion or any of the prizes to be awarded or whose goods, services, marks or likeness may be depicted in a Forever Young Collection or any Decalz, including Twitter, is a sponsor of or affiliated or connected in any way with the Promotion.
